TrueNerd Terms of Use

1. Who provides TrueNerd

TrueNerd is provided by Datacomb Solutions Inc. ("we", "us"). These Terms apply together with Apple's Standard End User License Agreement for apps from the App Store. Questions about these Terms: hello@truenerd.app.

2. Who may use TrueNerd

TrueNerd is not available to children under 13. Where the law requires it, TrueNerd uses the age range from your Apple Account, and a parent or guardian may need to approve TrueNerd through Apple. You must meet the eligibility requirements shown during setup and give accurate information.

3. Your account

TrueNerd has no sign-in. When setup finishes, TrueNerd creates an account that belongs to this installation of the app. If you delete the app, restore your device from a backup or move to a new device, the new installation gets a new account. Your lessons stay on the device where you made them. You can delete your account at any time in Settings › Account.

4. Subscription

TrueNerd is a monthly subscription that renews automatically. You buy and manage it with your Apple Account. The price and any free trial are shown before you buy. Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends. The subscription renews unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it in your Apple Account settings or with Manage Subscription in TrueNerd. Refunds are handled by Apple. A free trial is offered once per Apple Account. Your subscription works on every device signed in with the same Apple Account.

5. Monthly tutoring allowance

Each subscription includes a monthly tutoring allowance, shared by every device that uses the subscription. A free trial includes a smaller allowance. Settings › Account shows how much you have used and when the allowance resets. When it is used up, tutoring and voice pause until it resets, and you can keep writing in your notebook. If we change the allowance, we tell you in the app before the change applies.

6. Payment problems

If Apple can't collect a renewal payment, you keep tutoring without voice for up to 16 days while Apple retries. After that, tutoring stops until the payment goes through or you subscribe again. Your notebook stays usable.

7. AI tutoring

TrueNerd is an AI tutoring service. To create the tutor's replies, what you write, type, say and photograph in a lesson is sent to OpenAI. Replies can be wrong or incomplete, so check important answers. Follow your school's rules about getting help with your work.

8. Using TrueNerd fairly

Don't try to get around the allowance, access TrueNerd's servers other than through the app, or use TrueNerd to create harmful or unlawful content. Don't put other people's personal information into a lesson. If OpenAI or we find a serious violation, we may suspend tutoring for the subscription involved. 9. The service

We work to keep TrueNerd available and accurate, but we provide it as it is and may change or discontinue features. To the extent the law allows, we are not liable for indirect or consequential losses arising from your use of TrueNerd. Nothing in these Terms limits rights you have under the law where you live.

10. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada that apply there. This doesn't take away the protection that consumer laws give you where you live.

11. Changes to these Terms

When we make a material change, TrueNerd asks you to accept the updated Terms before your next lesson.
